Punch Clock MathHours, overtime and every state’s rules

Terms of Use

1. Who we are and what these terms cover

These terms apply to your use of Punch Clock Math (punchclockmath.com), operated by an individual based in the United States (“we”, “us”). By using the site you agree to them. If you don’t agree, please don’t use the site.

2. An independent site, not a government service

Punch Clock Math is an independent website. It is not a law firm, a payroll company, a tax preparer or a government agency, and it is not affiliated with, endorsed by or sponsored by the U.S. Department of Labor, the IRS, any state agency or any company named on this site. Names are used only to identify sources. Nothing on this site is a ruling, a wage claim, a pay stub, a payroll record or a tax form. Using the site does not file, change or start anything with any employer or agency.

3. Information, not professional advice

The site is informational. The calculators do arithmetic on the numbers you enter, using the rules shown with each tool, and the guides explain hours, overtime, pay and work rules in general terms. Nothing here is legal, tax, payroll or financial advice, and using the site does not create any professional relationship with us. You are not relying on us for any decision about your pay, your employees, your taxes or a claim.

For your own situation, ask the people who decide: your employer’s payroll records; your state labor department or the U.S. Department of Labor’s Wage and Hour Division about wage-and-hour law; the IRS or a tax professional about your return; an employment lawyer about a dispute. See the Disclaimer.

4. The calculators are estimates

  • Rules change. The calculators use the version of each rule we last read on the source’s own page, on the date shown with the tool. Check the source before you rely on a result.
  • Results depend on what you enter and on the assumptions shown with each tool: for example, that you are a non-exempt employee, and that no union contract, company policy or local law changes the answer.
  • Where a rule could not be confirmed, the site says “not confirmed” and the tools fall back to the federal rule instead of guessing. A result that leaves something out is not a promise that nothing else applies.
  • A time card you save stays in your browser; you are responsible for keeping your own records. We may change or remove a tool at any time.

5. Our content

The text, design, drawings and code of this site belong to the operator, except material credited to others, public government works and the trademarks of their owners. You may link to any page and quote short excerpts with a link back. Don’t copy whole guides or tables, republish the site’s content, or scrape it in bulk without written permission. Names of agencies and companies are used only to identify them.

6. Acceptable use

Don’t interfere with the site or its security, overload it with automated requests, or try to access anything that is not publicly offered.

The site links to other websites, mostly the agencies’ own pages, and will show ads served by Google. There are no affiliate links today; any added later will be marked where they appear. We don’t control other sites or ads and aren’t responsible for their content, products or practices. An ad on this site is not an endorsement.

8. No warranty

The site and tools are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, timeliness, fitness for a particular purpose and non-infringement. We don’t promise that the site is free of errors, that a result matches what an employer pays or what a tax return shows, or that a result suits your situation.

9. Limitation of liability

To the fullest extent the law allows, the operator is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost wages, profits, taxes, penalties or data, arising from your use of the site or the tools, including decisions you make based on them. Where liability can’t be excluded, it is limited to the greater of the amount you paid us to use the site (which is nothing) or US $50.

If you believe material on this site infringes your copyright, email hello@punchclockmath.com with the subject “DMCA notice” and include:

  1. your physical or electronic signature;
  2. a description of the copyrighted work you believe is infringed;
  3. the address (URL) of the material on this site;
  4. your name, mailing address, phone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.

We will review valid notices promptly and remove or disable infringing material. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address with the information required by 17 U.S.C. § 512(g).

11. Governing law

These terms are governed by the laws of the State of Georgia and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Georgia, unless the law where you live gives you the right to bring it elsewhere.

12. Changes

We may update these terms. The date at the top shows the latest version. Continuing to use the site after a change means you accept the updated terms.
